  • Removing Violations from Truck Driver PSP Record - May 03,20122012/05/03
    The Pre-Employment Screening Program (PSP), established by the FMCSA and maintained by their Motor Carrier Management Information System (MCMIS), allows motor carriers and individual drivers to purchase their driving records which contains the most recent 5 years of crash data and the most recent 3 years of roadside inspection data, including serious safety violations. Motor carriers may request PSP records only for the purpose of conducting pre-employment screening and only with the drivers written consent. The PSP record only contains MCMIS inspection and crash information that is uploaded to MCMIS by FMCSA federal staff and state partners (law enforcement). But as in the case of the truck driver DAC report, how does a driver go about having false information removed from their PSP record? Commercial truck drivers may obtain their PSP record either through the pre-employment screening program (PSP) or via the Freedom of Information Act (FOIA) website. But which way is best? And what assurance do drivers have that inaccurate violations will be removed? Special guest, Rickey Gooch of the Legal Benefits Group joins us as we discuss the many issues raised by the CSA and DataQ System and the rights that CMV drivers have pertaining to the accuracy of their FMCSAs PSP record.

  • Alcoholism: Truck Driving Disability - Sep 22,20112011/09/22
    The Equal Employment Opportunity Commission (EEOC) has filed a lawsuit against Old Dominion Freight for removing a driver from his driving duties, after he admitted to fears of an alcoholism relapse. The EEOC has stated that the driver is a "qualified individual with a disability under ADA, who can perform the essential functions of a driving position." While we applaud the driver for handling his problem with professional responsibility, why should the motor carrier be punished for their responsibility to highway and public safety? Where does the defintion of "Disability" end? Should sleep apnea be considered a disability? What about drug use? Should these be labeld as disabilities under the Americans with Disabilities Act? Every year, nearly 11,000 people are killed by a drunk driver, formulating out to be one person every 50 minutes. The EEOC proudly proclaims that they, "Enforce federal laws prohibiting employment discrimination, including disability and retaliation discrimination." Yet, they ignore the retaliation measures used against truck drivers via the DAC report. Is not "Safety First" the motto this year for the trucking industry? Is Old Dominion Freight in the wrong, or is this another example of the Federal Government spiralling out of control?
